Lamberth was sent to Charles City Co. after McKenny to arrest him as a deserter. McKenny later had $3 deducted from his pay. To cover the cost incurred in chasing him down. G. O. 57, A. N. Va., dated 18 Apr 1863, reported that McKenny's court martial found him guilty of being AWOL, but not of desertion. He was sentenced to lose $10 per month for 8 months, and to serve 2 months at hard labor wearing a 12 lb. ball on a 3 ft. chain. A later decree sent him to Staunton to do the hard labor on public roads. He was on a post-war pension list.
